The presidential control is realized through the implementation of general management by the Head of the State over the SZRU, by the appointment of the leadership, by tasking and by the accountability of the Foreign Intelligence Service of Ukraine on its performance. The SZRU reports in the prescribed manner to the President of Ukraine on the issues specified by him. The President of Ukraine also exercises the control over the activities of the Intelligence through the Council of National Security and Defense of Ukraine. At the same time the constant participation of the Intelligence in the development of the state policy in the domain of the national security is provided due to the permanent affiliation of the Chairman of the SZRU to the Council of National Security and Defense of Ukraine.
The parliamentary control over the Intelligence Service is realized by the Verkhovna Rada of Ukraine and by the Committee of National Security and Defense of the Verkhovna Rada of Ukraine. The discussions and hearings of certain issues are also practiced during the sessions of the Committee or during the field meetings directly at the HQ of the SZRU.
The monitoring of expenditure of the State Budget of Ukraine on the maintenance of the SZRU is executed by the Accounting Chamber of Ukraine through the special group consisting of its members.
The supervision over the compliance of the SZRU with the laws is fulfilled by the Prosecutor General of Ukraine and by the attorneys authorized by him in accordance with the Constitution and the laws of Ukraine.
The Law of Ukraine “On the Democratic Civilian Control over the Military Establishment and State Law Enforcement Bodies” adopted by the Verkhovna Rada of Ukraine has defined the legal grounds for ensuring the greatest possible transparency of the activity of the state in the sphere of national security and defense. The law also foresees the civilian control over the activity of the SZRU, which is exercised by the citizens of Ukraine through the public organizations they are affiliated with, through the deputies of the representative bodies and personally by the appeal to the Commissioner for Human Rights of the Verkhovna Rada of Ukraine and his representative for protection of the rights of military personnel, or by the appeal to any other state body in the order determined by the Constitution of Ukraine and the Law of Ukraine “On the Citizens’ Appeals”.
This allocation of oversight powers corresponds to the democratic examples and is close to the basic principles of the control and supervision over the activity of the intelligence according to the European norms.
The mechanisms of the civilian control over the activity of the SZRU are constantly being developed and perfected.
